1335668 <br />Councilmember Zimmerman introduced the folio.wing resolution and moved For its adoption: <br /> <br />RESOLUTION #97-08-208 <br /> <br />A RESOLUTION APPROVING THE ISSUANCE OF A CONDITIONAL USE PERMIT <br />FOR THE CONSTRUCTION AND OPERATION OF A PERSONAL <br />COMMUNICATION SERVICE (PCS) TOWER AND DECLARING TERMS OF SAME <br /> <br /> WHEREAS, AMERICAN PORTABLE TELECOM (APT) has properly applied for a <br />conditional use permit to construct and operate a telecommunications tower on a 50' x 50' <br />section (site) of the property legally described as follows: <br /> <br /> The north 426.29 feet as measured along the West Line of that part of the Southwestern <br /> Quarter of the Southeastern Quarter of Section 11, Township 32, Range 25, A~.oka <br /> County, Minnesota, lying westerly of the centerline of State Highway No. 47 (subject to <br /> road and highway easements over the north and east 33 feet). <br /> <br /> ("Subject Property") <br /> <br /> WHEREAS, the Planning Commission met on August 5, 1997, conducted the public <br />hearing and recommended City Council approval of the request. <br /> <br /> NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE <br />CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />Based on Findings of Fact #0438, a conditional use permit for a 50 meter (approximately <br />165 feet) monopole and related equipment cabinets is hereby granted to APT and Rum <br />River Plaza Associates, hereinafter referred to as "Permit Holder". <br /> <br />This permit is perpetual in its duration so long as the terms imposed herein are complied <br />with. <br /> <br />The development of the Site shall be in accordance with tl~e 4 sheet site plan prepared by <br />Fluor Daniel, Inc., dated July 11, 1997, and the written support materials prepared by <br />Michelle R. Johnson, Zoning Coordinator, Cellular. Realty Advisors, Inc., on behalf of <br />APT, dated July 9, 1997. <br /> <br />The development of the Site shall include the construction of an eight-foot-high privacy <br />fence along the west property line of both the Subject Property and the immediate parcel <br />to the south, with the supporting structure of the fence facing east. The Permit Holder <br />shall be responsible for the proper maintenance of said fence. <br /> <br />The site shall be landscaped in accordance with the Tower Screening Plan developed by <br />the City of Ramsey dated 8/19/97. In order to insure the installation of the plantings by <br />June 30, 1998, the Permittee shall be required to deposit with the City a cash escrow or <br /> <br /> <br />
