Councilmember Haas Steffen introduced the following resolution and moved for its adoption: RESOLUTION #97-09-283 A RESOLUTION ADOPTING FINDINGS OF FACT #0441 RELATING TO A REQUEST FROM BARBARA NELSON FOR A HOME OCCUPATION PERMIT AT 5211 155TH LANE NW WHEREAS, the City of Ramsey received an application fi.om Barbara Nelson for a home occupation permit to operate a hair and nail salon within the dwelling on the property generally known as 5211 155th Lane NW and legally described as follows: Lot 12, Block 3, Woodland Green, Anoka County, Minnesota (the "Subject Property") NOW THEREFORE, BE IT RESOLVED BY THIS CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA that the findings of fact relating to the request are determined to be as follows: That on August 6, 1997, Barbara Nelson, hereinafter referred to as "Applicant", properly applied for a home occupation permit to establish and operate a hair and nail salon in her home. That the applicant appeared before the Ramsey Planning Commission for a public hearing pursuant to Section 9.03.04 of the City Code on September 2, 1997, and that said public hearing was properly advertised and that the minutes of said public hearing are hereby incorporated as a part of these findings by reference. o That the Subject Property and surrounding parcels to the east, south and west are zoned R-1 Rural Residential; the adjacent property to the north is a City park. 4. That the Subject Property is approximately .9 acres in size. 5. That beauty salons are not a permitted use in the R-1 Rural Residential District. o That the Applicant has provided documentation to support that the home occupation will be conducted within the private dwelling on the property, that the area set aside for the home occupation does not exceed 20% of the total floor area of the private dwelling, and the operation will not include any employment of persons not residing in the private dwelling in the performance of the home occupation. 7. That the Applicant will reside at the location of the proposed home occupation.
