NOW THEREFORE, BE IT RESOLVED BY THIS CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA that the findings of fact relating <br />to the request are determined to be as follows: <br /> <br />That on August 14, 1997, John Enstrom, hereinafter referred to as "Applicant", applied for <br />a conditional use permit to grade and export excess soils from the Subject Property. <br /> <br />That the applicant appeared before the Ramsey Planning Commission for a public hearing <br />pursuant to Section 9.03.04 of the City Code on September 2, 1997, and that said public <br />hearing was properly advertised and that the minutes of said public hearing are hereby <br />incorporated as a part of these findings by reference. <br /> <br />That the Applicant has submitted a four (4) page 'Information For Conditional Use <br />Permit', and an exhibit labeled Exhibit A, and a non-reproducible aerial photo dated <br />received by the City on August 14, 1997. <br /> <br />That the Applicant is proposing to create a pond by excavating an area of 12 acres to a <br />mean depth of six feet, dry the excavated material and export it off the site as topsoil. <br /> <br />That the Applicant states that the amount of fill exported from the Subject Property will be <br />approximately 116,000 yards. <br /> <br />That the Applicant has stated that the proposed haul route for incoming and outgoing <br />tracks will be as depicted on Exhibit A commencing at a point approximately on the <br />northeastern comer of the excavated area and proceeding due north through the cropped <br />parcel and intersecting with County Road #64 at the intersection with Rabbit Street located <br />in Bums Township. <br /> <br />7. That no fill materials, except topsoil for restoration, are proposed to be imported to the site. <br /> <br />8. That no blasting will be employed in the grading activity. <br /> <br />That the existing drainage patterns will not be substantially altered by the proposed grading <br />plan. <br /> <br />10. That the grading plan proposes to install silt fence to control erosion. <br /> <br />11. That the grading operation will increase the traffic to and from the subject property for the <br /> period of time the permit is in effect. <br /> <br />12.
