22. <br /> <br />The brush stockpiles shall be covered with excavated material to hasten their <br />decomposition. Periodic vent holes shall be left in the cover to prevent anaerobic <br />conditions from developing. Brush stockpiles shall be limited to a height of 20 feet. <br /> <br />23. <br /> <br />Silt fence shall be installed a minimum of 30 feet from the nearest edge of the County <br />ditch and no tree cleaning or excavation shall take place within this buffer. <br /> <br />24. <br /> <br />The Permit Holder shall obtain necessary permits from other regulatory agencies which <br />may be required for the temporary or permanent placement of fill in wetlands. <br /> <br />25. <br /> <br />All grading and export operations shall be conducted between 7:00 a.m. and 5:00 p.m. on <br />weekdays and from 7:00 a.m. to 3:00 p.m. on Saturdays, unless otherwise specifically <br />approved by the City Administrator and/or his designee. <br /> <br />26. <br /> <br />The amount of dust or other particulate matter caused by the mining operation shall not <br />exceed the standards established by the Minnesota Pollution Control Agency. No <br />operation shall be allowed when wind gust exceed 30 miles per hour, <br /> <br />27. <br /> <br />All operations shall comply with all applicable Minnesota Pollution Control Agency <br />regulations and Federal and Environmental Protection Agency regulations for the <br />protection of water quality. <br /> <br />28. <br /> <br />All costs incurred by the City in executing and administering this permit shall be the <br />responsibility of the permit holder. The permit holder shall maintain a minimum Five <br />Hundred Dollar ($500.00) balance in an escrow account with the City. This escrow shall <br />be used to reimburse the City for expenses incurred in the administration of this permit. <br />At the time the mining operation and site restoration are completed to the satisfaction of <br />the City, the balance of the escrow shall be returned to the Permit Holder. <br /> <br />The motion for the adoption of the foregoing resolution was duly seconded by Councilmember <br />Beyer, and upon vote being taken thereon, the following voted in favor thereof: <br /> <br />Mayor Gamec <br />Councilmember Haas Steffen <br />Councilmember Beyer <br />Councilmember Beahen <br />Councilmember Zimmerman <br /> <br />and the following voted against the same: <br /> <br />None <br /> <br />and the following abstained: <br /> <br />None <br /> <br />RESOLUTION #97-09-286 <br /> Page 5 of 7 <br /> <br /> <br />
