o <br /> <br />10. <br /> <br />11. <br /> <br />12. <br /> <br />13. <br /> <br />14. <br /> <br />Subject Property, which is the proposed plat of Apple Ridge, which plat received <br />preliminary plat approval from the City Council on June 24, 1997. <br /> <br />That the applicant appeared before the Ramsey Planning Commission for a public hearing <br />pursuant to Section 9.03.04 of the City Code on September 2, 1997, and that said public <br />hearing was properly advertised and that the minutes of said public hearing are hereby <br />incorporated as a part of these findings by reference. <br /> <br />That in conjunction with preliminary plat approval on June 24, 1997, the Ramsey City <br />Council approved the Grading Plan for the Subject Property prepared by Passe <br />Engineering, Inc., dated March 11, 1997, revision date July 22, 1997. <br /> <br />That the approved Grading Plan requires the removal of approximately 120,000 yards of <br />earth material from the Subject Property. <br /> <br />That City Code does not require a conditional use permit to grade soils when it is for <br />compliance with a grading plan that has been approved as part of a subdivision plat, <br />unless said plan requires exporting material from the site. <br /> <br />That the Applicant has stated that the proposed haul route for incoming and outgoing <br />trucks will be from T.H. #47. <br /> <br />That no fill materials are proposed to be imported to the site. <br /> <br />That no blasting will be employed in the grading activity. <br /> <br />That the grading operation will increase the traffic to and from the subject property for a <br />two year time frame. <br /> <br />That the proposed use will not be unduly dangerous or otherwise detrimental to persons <br />residing or working in the vicinity of the use or to the public welfare. <br /> <br />That the proposed use will not substantially adversely impair the use, enjoyment, or <br />market value of any surrounding property. <br /> <br />That the proposed use will not be hazardous or disturbing to existing or future <br />neighboring uses. <br /> <br />That the proposed use will be a substantial improvement to property in the immediate <br />vicinity and to the community as a whole. <br /> <br />That the proposed use will be served adequately by public facilities and services such as <br />highways and streets. <br /> <br />RESOLUTION #97-09-287 <br /> Page 2 of 3 <br /> <br /> <br />
