Board Member Bawden introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #97-10-299 <br /> <br />A RESOLUTION ADOPTING FINDINGS OF FACT /40443 RELATING TO A <br />REQUEST FOR A VARIANCE TO THE HEIGHT RESTRICTIONS IN THE B-3 <br />BUSINESS DISTRICT AND THE CRITICAL AND WILD AND SCENIC RIVER <br />OVERLAY DISTRICTS <br /> <br /> WHEREAS, L.A.N.D. Properties, Inc., hereinafter referred to as "Applicant", has <br />properly applied for a Board of Adjustment variance from structure height restrictions to develop <br />a 3~story motel with extended parapet walls on the property legally described as follows: <br /> <br />Lot 1, Block 1, RIVERSIDE WEST, Anoka County, Minnesota. <br /> <br />(the "Subject Property") <br /> <br /> NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF ADJUSTMENT <br />OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />That the Applicant appeared before the Board of Adjustment for a public hearing <br />pursuant to Section 9.03.05 of the Ramsey City Code on October 21, 1997 and that said <br />public hearing was properly advertised and that the minutes of said public hearing are <br />hereby incorporated as a part of these findings by reference. <br /> <br />That the subject property is zoned B-3 Highway Business and is approximately 5 acres in <br />size. <br /> <br />That the Subject Property is located in the Mississippi Critical River Overlay District and <br />the Wild and Scenic River Overlay District. <br /> <br />That the property to the north, west and east is zoned B-3 Highway Business, and the <br />property to the south is zoned R-1 Urban Residential. <br /> <br />That Section 9.20.23 (B-3 Highway Business Dis.tricO, Section 9.21.07 (Critical River <br />Overlay District Development Standards), and Section 9.23.06 (Scenic River Overlay <br />District Development Standards) establishes a structure height restriction of 35 feet. <br /> <br />That Section 9.11.15. (Permitted Encroachments) states that parapet walls not extending <br />more than four feet above the limiting height of the building are permitted <br />encroachments. <br /> <br />That the Applicant is proposing to develop a 3 story motel on the subject property that is <br />35 feet in height but includes parapet walls for architectural enhancement purposes that <br />are 44'6" from grade at their highest point, which results in a 5'6" extension into the <br />established height restriction in combination with the permitted encroachment allowance. <br /> <br /> <br />
