Board Member Bawden introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION/497-11-321, <br /> <br />A RESOLUTION APPROVING THE ISSUANCE OF A VARIANCE AND <br />DECLARING TERMS OF SAME. <br /> <br /> WHEREAS, Barr, Mach, & Rows, Inc. (Permittee) has properly applied for a <br />variance from the rear yard setback requirements in the B-3 Highway Business District <br />on the property generally known as 7105 Hwy. #10 N.W. and legally described as <br />follows: <br /> <br />That part of the Southwest Quarter of the Southwest Quarter of Section 27, <br />Township 32, Range 25, and the Northwest Quarter of the Northwest Quarter of <br />Section 34, Township 32, Range 25, described as follows: Beginning at the point <br />in intersection of the Northeasterly fight-of-way of U.S. Trunk Highway No. 10 <br />and a line parallel with and distant 511.5 feet East of the West line of the <br />Southwest Quarter of the Southwest Quarter of Section 27, Township 32, Range <br />25; thence North and parallel with said West line of said Southwest Quarter of <br />Southwest Quarter of Section 27, Township 32, Range 25, a distance of 147.58 <br />feet; thence Southeasterly parallel with said Northeasterly fight-of-way line of <br />said Highway a distance of 147.58 feet; thence South parallel with said West line <br />of said Southwest Quarter of Southwest Quarter a distance of 147.58 feet to the <br />Northeasterly right-of-way line of said Highway 10; thence Northwesterly along <br />the said Highway 10 a distance of 147.58 feet to the point of beginning, Anoka <br />County, Minnesota. <br /> <br />(the "Subject Property"); and <br /> <br /> WHEREAS, the Board of Adjustment met on November 4, 1997, conducted the <br />public hearing and adopted findings of fact relating to the request for a variance from <br />height restrictions. <br /> <br /> NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF <br />ADJUSTMENT OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF <br />MINNESOTA, as follows <br /> <br />Based on Findings of Fact #0447, a variance to rear yard setback requirements is <br />hereby granted. <br /> <br />The accessory building developed on the Subject Property shall not be located <br />within (fifteen) feet of the rear property line. <br /> <br /> <br />
