Councilmember Beyer introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #98-03-040 <br /> <br /> A RESOLUTION ADOPTING FINDINGS OF FACT #0450 RELATING TO <br />A REQUEST FOR A CONDITIONAL USE PERMIT TO OPERATE A TWO FAMILY <br />DWELLING UNIT IN THE R-1 RURAL RESIDENTIAL DISTRICT <br /> <br /> WHEREAS, Scott and Gwyn Simpson, hereinafter referred to as "Applicants", have <br />properly applied for a Conditional Use Permit to operate an existing structure in the R-1 Rural <br />Residential District as a two family dwelling unit on .the property generally known as 16001 <br />Nowthen Blvd. N.W. and legally described as follows: <br /> <br />That part of the east 100 feet of the Northeast Quarter of the Southeast Quarter of Section <br />15, Township 32, Range 25, Anoka County, Minnesota lying northeasterly of the County <br />State Aid Highway Number 5 (also known as Nowthen Boulevard. <br /> <br /> NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />That the Applicant appeared before the Planning and Zoning Commission for a public <br />hearing pursuant to Section 9.03.04 of the Ramsey City Code on February 3, 1998, and that <br />the public hearing was properly advertised and that the minutes of said public hearing are <br />hereby incorporated by reference. <br /> <br />2. That the subject property is approximately 1.5 acres in size. <br /> <br />3. That the subject property is zoned R-1 Rural Residential. <br /> <br />4. That the surrounding properties are also zoned R-1 Rural Residential. <br /> <br />5. That according to Ramsey City Code Section 9.20.11, the R-1 Rural Residential District is <br /> intended for single family dwelling units. <br /> <br />That the City records indicate that the existing dwelling structure was constructed in 1981 <br />and because of the suspicious nature of the floor plan (3 bedrooms and a kitchen on each <br />level), the homeowner/builder was required to sign a statement acknowledging the R-1 <br />Residential zoning on the property and that a special use permit would be required to <br />maintain the dwelling as anything other than a single family home. <br /> <br />That the City records indicate that the dwelling has been used as a two family dwelling unit <br />in the past without benefit of a conditional use permit and this is an illegal use of the <br />property, and that a more timely reaction on the part of the City to those records may have <br />prohibited or prevented the proliferation of the illegal use. <br /> <br /> <br />
