Councilmember Haas Steffen introduced the following resolution and moved for its adoption: RESOLUTION #98-03-053 RESOLUTION AUTHORIZING ACQUISITION OF PROPERTY FOR HIGHWAY PURPOSES WHEREAS, the extension of C.R. #116 between C.R. //56 and C.R. //83 will greatly enhance the arterial transportation network within the City of Ramsey, and consequently will benefit the health, safety and welfare of the City; and WHEREAS, Anoka County requires the City to obtain the right-of-way for this road extension; and WHEREAS, the City finds it necessary to acquire fee title to the real property described below for the required right-of-way, a permanent utility easement for the necessary drainage facilities associated with the new roadway and temporary construct easements to facilitate the construction; and WHEREAS, the City has authority to acquire the real property for the Public Improvement by eminent domain pursuant to Minn. Stat. Chapter 117; and WHEREAS, the City has the right to acquire the real property prior to the filing of an award by the Court appointed commissioners, pursuant to Minn. Stats. §117.011 and §117.042; and WHEREAS, the real property which needs to be acquired is legally described as follows: Fee title to a 120.00 strip of land for road, drainage and utility purposes, over, under and across the Northwest Quarter of Section 28, Township 32, Range 25, Anoka County, Minnesota, the centerline of which is described as follows: Beginning at the intersection of the east line of the Southeast Quarter of said Northwest Quarter and a line 90.00 feet south of and parallel with the north line of the Southeast Quarter of said Northwest Quarter; thence North 89 degrees 29 minutes 01 seconds West, assumed bearing along said parallel line, a distance of 188.54 feet; thence northwesterly a distance of 821.52 feet along a tangential curve concave to the northeast, said curve having a radius of 1099.07 feet and a central angle of 42 degrees 49 minutes 37 seconds; thence North 46 degrees 39 minutes 23 seconds West, tangent to the last described curve, a distance of 644.13 feet to a point hereinafter referred to as "Point A"; thence westerly a distance of 821.51 feet along a tangential curve concave to the south, said curve having a radius of 1099.07 feet and a central angle of 42 degrees 49 minutes 35 seconds; thence North 89 degrees 28 minutes 58 seconds West, tangent to the last described
