WHEREAS, the property owners of the real property which needs to be acquired have <br />been identified by the City as follows: <br /> <br />Thomas Kurak and Pattiann Kurak, fee owners of a portion of the property and option <br />holders of a portion of the property. <br /> <br />Elda Schenk and Nancy Gybers, fee owners of a portion of the property. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />That the City Administrator is hereby directed to acquire the real property as described <br />above in accordance with Minnesota Statutes. The City Administrator is authorized to <br />negotiate and represent the City of Ramsey in all proceedings. <br /> <br />That if the real property as described above cannot be acquired by direct negotiation, it <br />shall be acquired by eminent domain. <br /> <br />That the City Council hereby authorizes acquisition of the said real property by eminent <br />domain and to take title and possession of that land prior to filing of an award by the <br />Court Appointed Commissioners pursuant to Minnesota Statues § 117.011 and § 117.042. <br /> <br />That the City Attorney is authorized to file the necessary petition therefore, and to <br />prosecute such action to a successful conclusion or until it is abandoned, dismissed for <br />terminated by the City or Court. <br /> <br />o <br /> <br />That the City Administrator is authorized to expend necessary funds for appraisals of <br />above described real property. <br /> <br />The motion for the adoption of the foregoing resolution was duly seconded by Councilmember <br />Beyer, and upon vote being taken thereon, the following voted in favor thereof: <br /> <br />Mayor Gamec <br />Councilmember Haas Steffen <br />Councilmember Beyer <br />Councilmember Beahen <br />Councilmember Zimmerman <br /> <br />and the following voted against the same: <br /> <br />None <br /> <br />RESOLUTION #98-03-053 <br /> Page 3 of 4 <br /> <br /> <br />
