28-32-25-22-0002 28-32-25-22-0003 WHEREAS, the property owners of the real property which needs to be acquired have been identified by the City as follows: Thomas Kurak and Pattiann Kurak, fee owners of a the property and option holders of a portion of the property. Elda Schenk and Nancy Gybers, fee owners of a portion of the property. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: That the City Administrator is hereby directed to acquire the real property as described above in accordance with Minnesota Statues. The City Administrator is authorized to negotiate and represent the City of Ramsey in all proceedings. That is the real property as described above cannot be acquired by direct negotiation, it shall be acquired by eminent domain. That the City Council hereby authorizes acquisition of the said real property by eminent domain and to take title and possession of that land prior to filing of an award by the Court Appointed Commissioners pursuant to Minnesota Statutes §117.011 and §117.042. That the City Attorney is authorized to file the necessary petition therefore, and to prosecute such action to a successful conclusion or until it is abandoned, dismissed or terminated by the City or Court. That the City Administrator is authorized to expend necessary funds for appraisals of above described real property. The motion for the adoption of the foregoing resolution was duly seconded by Councilmember Zimmerman and upon vote being taken thereon, the following voted in favor thereof: Mayor Gamec Councilmember Beyer Councilmember Zimmerman Councilmember Beahen and the following voted against the same: None RESOLUTION #98-04-064 Page 3 of 4
