28-32-25-22-0002 <br />28-32-25-22-0003 <br /> <br /> WHEREAS, the property owners of the real property which needs to be acquired have <br />been identified by the City as follows: <br /> <br />Thomas Kurak and Pattiann Kurak, fee owners of a the property and option holders of a <br />portion of the property. <br /> <br />Elda Schenk and Nancy Gybers, fee owners of a portion of the property. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />That the City Administrator is hereby directed to acquire the real property as <br />described above in accordance with Minnesota Statues. The City Administrator is <br />authorized to negotiate and represent the City of Ramsey in all proceedings. <br /> <br />That is the real property as described above cannot be acquired by direct <br />negotiation, it shall be acquired by eminent domain. <br /> <br />That the City Council hereby authorizes acquisition of the said real property by <br />eminent domain and to take title and possession of that land prior to filing of an <br />award by the Court Appointed Commissioners pursuant to Minnesota Statutes <br />§117.011 and §117.042. <br /> <br />That the City Attorney is authorized to file the necessary petition therefore, and to <br />prosecute such action to a successful conclusion or until it is abandoned, <br />dismissed or terminated by the City or Court. <br /> <br />That the City Administrator is authorized to expend necessary funds for appraisals <br />of above described real property. <br /> <br />The motion for the adoption of the foregoing resolution was duly seconded by Councilmember <br />Zimmerman and upon vote being taken thereon, the following voted in favor thereof: <br /> <br />Mayor Gamec <br />Councilmember Beyer <br />Councilmember Zimmerman <br />Councilmember Beahen <br /> <br />and the following voted against the same: <br /> <br />None <br /> <br />RESOLUTION #98-04-064 <br /> Page 3 of 4 <br /> <br /> <br />
