Councilmember Beahen introduced the following resolution and moved for its adoption: RESOLUTION//98-04-068 RESOLUTION AUTHORIZING THE GRANT OF AN EASEMENT FOR ROADWAY AND UTILITY PURPOSES OVER, UNDER AND ACROSS A PORTION OF CITY OWNED PROPERTY WHEREAS, the City is the fee owner of the following described property: That part of Government Lot 1, Section 35, Township 32, Range 25, Anoka County, Minnesota, that is described as follows: Commencing at the meander comer on the west line of said Section 35, which point is 620.5 feet south of the West Quarter comer of said Section 35; thence considering the west line of said Section 35 to be a tree meridian, south 55 degrees 12 minutes East 375.44 feet; thence South 68 degrees 17 minutes East 106 feet to the point of beginning of the tract of land to be hereby described; thence north and parallel to the west line of said Section 35 for a distance of 560.6 feet; thence west at fight angles to said parallel line to a point that is 308.5 feet east of the west line of said Section 35 measured on a line parallel to the north line of said Government Lot 1; thence south and parallel to the west line of said Section 35 to the Mississippi River; thence southeasterly along the shore of the Mississippi River to an intersection with the extension south of the first course herein; thence north on said extension to the point of beginning; AND WHEREAS, said property is adjacent to Riverdale Drive and is adjacent to property owned by All-Brite Graphics, Inc.; and WHEREAS, All-Brite Graphic, Inc. finds it necessary to acquire a access easement to its property across the City owned property above described; and WHEREAS, the City Council finds that its ownership of the above described property will not be adversely impacted by the grant of the easement requested. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: 1. That the City grants a permanent easement for roadway and utility purposes over, under and across that certain real property described on Exhibit "A" attached hereto. That the motion of the City Council on June 24, 1997 is reaffirmed by this resolution and that the Quit Claim Deed executed by the Mayor and City Administrator on February 10, 1998 conveying the above described easement to All-Brite Graphic, Inc. is affirmed and authorized by this resolution.
