Couneilmember Zimmerman moved for the adoption of the following findings of fact: RESOLUTION #98-07-160 A RESOLUTION ADOPTING FINDINGS OF REQUEST FOR A CONDITIONAL USE COMMUNICATION SERVICE (PCS) TOWER FACT #0463 RELATING TO A PERMIT FOR A PERSONAL WHEREAS, U.S. West Wireless (APT), hereinafter referred to as "Applicant", has properly applied for a Conditional Use Permit to construct, install and operate a personal communications system (pcs) on the property generally known as 9421 Hwy. #10 NW and legally described as follows: That part of the Southwest Quarter of the Northwest Quarter of Section 19, Township 32, Range 25, lying southwesterly of the Southwesterly Right-of-Way Line of Burlington Northern Railroad, westerly of the Westerly Line of Outlot D, Northfork, easterly of the most Easterly Line of Lot 2, Block 1, Ramsey Commercial Park, northerly of the Northerly Right-of-Way Line of U.S. Trunk Highway No. 10, 52 and 169 and southeasterly of the following described line: Commencing at the most northerly corner of Outlot D, Northfork; thence north 39 degrees 01 minutes 26 seconds west along said Southwesterly Right-of-Way Line 340 feet to the point of beginning; thence south 50 degrees 58 minutes 34 seconds west 162 feet; thence southwesterly along a tangential curve concave to the southeast, a radius of 1887.83 feet, a central angle of 12 degrees 21 minutes 17 seconds a distance of 407.07 feet and thereby terminating; except road; subject to easement of record. (the "Subject Property"). NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: That the Applicant appeared before the Planning Commission for a public hearing pursuant to Section 9.03.04 of the Ramsey City Code on July 7, 1998, and that said public hearing was properly advertised and that the minutes of said public hearing are hereby incorporated by reference. That the Subject Property is located in the B-1 Business District, is approximately 7 acres in size, and is owned by Carrol and Frances Welte. That the Applicant is proposing to lease a 30' x 40' section of the Subject Property (Site) to facilitate the development of the tower. That the property to the property to the north is occupied by the Burlington Northern railroad, the parcels to the east and west are also zoned B-1 Business, and the Subject Property is bounded by Hwy. #10 on the south.
