Councilmember Beahen introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #98-07-162 <br /> <br />A RESOLUTION ADOPTING FINDING OF FACT #0464 RELATING TO A REQUEST <br />FROM MICHAEL LEBLANC FOR A CONDITIONAL USE PERMIT TO GRADE AND <br />EXPORTS SOILS <br /> <br /> WHEREAS, the City of Ramsey received an application from Michael LeBlanc for a <br />conditional use permit to grade and export excess soils from the property legally described as <br />follows: <br /> <br />Lots 1, 2 and 3, Block 1, PINEVIEW ESTATES 2ND ADDITION, ANOKA COUNTY, <br />MINNESOTA <br /> <br />(the "Subject Property"). <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THIS CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA that the findings of fact relating <br />to the request are determined to be as follows: <br /> <br />That on July 7, 1998, Michael LeBlanc, hereinafter referred to as "Applicant", applied for a <br />conditional use permit to grade and export excess soils from the Subject Property. <br /> <br />That the applicant appeared before the Ramsey Planning Commission for a public hearing <br />pursuant to Section 9.03.04 of the City Code on July 7, 1998, and that said public heating <br />was properly advertised and that the minutes of said public heating are hereby incorporated <br />as a part of these findings by reference. <br /> <br />o <br /> <br />That the Applicant is proposing to mine an area of approximately 5 acres to a mean depth <br />of 7 feet. <br /> <br />That the Applicant states that the amount of fill exported from the Subject Property will be <br />approximately 50,000 to 60,000 yards. <br /> <br />That the proposed haul route for incoming and outgoing trucks will be from the <br />southwestern coruer of the site, due south for a distance of approximately 700 feet, then <br />due eastward using a gravel road (constructed by the City for access to Well Nos. 3 and 4) <br />for a distance of ½ mile. Access from the public road system shall be at the intersection of <br />C.R. #116 and C.R. #56. <br /> <br />6. That no fill materials, except topsoil for restoration, are proposed to be imported to the site. <br /> <br />7. That no blasting will be employed in the grading activity. <br /> <br />That the existing drainage patterns will not be substantially altered by the proposed grading <br />plan. <br /> <br /> <br />
