Councilmember Beahen introduced the following resolution and moved for its adoption: <br /> RESOLUTION #98-07-165 <br /> RESOLUTION APPROVING THE ISSUANCE OF A CONDITIONAL USE PERMIT <br /> BASED ON FINDINGS OF FACT #465 AND DECLARING TERMS OF PERMIT TO <br /> GRADE AND IMPORT SOILS <br /> WHEREAS,the Ramsey City Council adopted Resolution 498-07-164 adopting Findings <br /> of Fact 4465 for this use and herein approves the Conditional Use Permit subject to the following <br /> conditions. <br /> NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br /> RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> On , 1998 a Conditional Use Permit("CUP")was issued by the City of Ramsey <br /> ("City") to North Fork, Inc. ("Permit Holder") for grading operations on the property legally <br /> described as follows: <br /> Lots 7 and 8, Block 4, Northfork, Anoka County, Minnesota <br /> (hereinafter referred as "Site A"). <br /> -and- <br /> Lots 5, 6, 7 and 8, Block 3 Northfork Links Addition, Anoka County, Minnesota <br /> (hereinafter referred to as "Site B"). <br /> This permit is issued pursuant to Section 9.03.04 and 9.1.18 of the Ramsey City Code. The <br /> conditions of this permit are as follows: <br /> 1) This permit shall expire three (3)years from the date of commencement of operations and <br /> the Permit Holder shall be responsible for providing the City with at least 48 hours advance <br /> notice of the date of commencement of operations. This Permit shall allow for the grading <br /> of Site A in accordance with the Grading Plan prepared by Ulteig Engineering and dated <br /> 2) The ingress and egress to Site B shall be from Andrie Street N.W. The Permit Holder shall <br /> promptly sweep the street in front of the access to site B at the end of each day in which <br /> hauling takes place. The Permit Holder shall be responsible for removing any spilled <br /> material from the public roads immediately upon direction to do so by the City Engineer. <br /> Failure to do so shall be cause for the City Engineer to order the necessary work to be done <br /> and billed to the Permit Holder. <br /> 3) All grading operations for Site A shall be conducted in accordance with the plan prepared <br /> by Ulteig Engineering and dated June 30, 1998, or any subsequent revision approved by <br /> the City Engineer. All grading operations for Site B shall be conducted in accordance with <br /> the one (1) sheet Grading Plan prepared by Ulteig Engineering, Inc. and dated June 29, <br /> 1995.
