21) All costs incurred by the City in executing and administering this permit shall be the responsibility of the permit holder. The permit holder shall maintain a minimum Five Hundred Dollar ($500.00) balance in an escrow account with the City. This escrow shall be used to reimburse the City for expenses incurred in the administration of this permit. A the time the mining operation and site restoration are completed to the satisfaction of the City, the balance of the escrow shall be returned to the Permit Holder. 22) All grading operations shall be conducted between 7:00 a.m. and 8:00 p.m. on weekdays only unless otherwise specifically approved by the City Administrator and/or his designee. 23) The amount of dust or other particulate mater caused by the mining operation shall not exceed the standards established by the Minnesota Pollution Control Agency.No operation shall be allowed when wind gust exceed 30 miles per hour. 24) All operations shall comply with all applicable Minnesota Pollution Control Agency regulations and Federal and Environmental Protection Agency regulations for the protection of water quality. The motion for the adoption of the foregoing findings of fact was duly seconded by Councilmember Zimmerman, and upon vote being taken thereon, the following voted in favor thereof: Mayor Gamec Councilmember Beahen Councilmember Zimmerman and the following voted against the same: None and the following abstained: None and the following were absent: Councilmember Beyer Councilmember Haas Steffen Whereupon said findings of fact was declared duly passed and adoppd by Ramsey City Council this the 28h day of July, 1998. t:= ,........
