Councilmember Haas Steffen introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #98-08-206 <br /> <br />A RESOLUTION ADOPTING FINDING OF FACT/10468 RELATING TO A REQUEST <br />FROM RONALD J. KABAT FOR A CONDITIONAL USE PERMIT TO GRADE AND <br />EXPORTS SOILS <br /> <br /> WHEREAS, the City of Ramsey received an application from Ronald J. Kabat for a <br />conditional use permit to regrade the property legally described as follows: <br /> <br />Lot 4, Block 5, Fox Ridge Estates 2nd Addition, ANOKA COUNTY, MINNESOTA <br /> <br />(the "Subject Property"). <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THIS CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA that the findings of fact relating <br />to the request are determined to be as follows: <br /> <br />That on July 15, 1998, Ronald J. Kabat, hereinafter referred to as "Applicant", applied for <br />a conditional use permit to grade and fill an area of the rear yard measuring <br />approximately 44' x 150' x 4' utilizing earth material from a drainage pond and dirt <br />mound located on the site. <br /> <br />That the applicant appeared before the Ramsey Planning Commission for a public hearing <br />pursuant to Section 9.03.04 of the City Code on August 4, 1998, and that said public <br />hearing was properly advertised and that the minutes of said public hearing are hereby <br />incorporated as a part of these findings by reference. <br /> <br />That the Applicant submitted a 3-sheet set of project plans dated July 15, 1998 and is <br />proposing to mine earth material from a dirt mound and from the pond, which would <br />expand the southeast comer of the pond approximately 40 feet and increase the depth of <br />the entire pond from 6 inches to approximately 3 feet. <br /> <br />That the fill materials obtained from the earth mound and drainage pond will be used to <br />fill an area behind the home to a more useable elevation. <br /> <br />o <br /> <br />That the Applicant states that the utilities, well and septic system are located south of the <br />proposed grading area and will not be affected by the project. <br /> <br />o <br /> <br />That no fill materials, except perhaps topsoil for restoration, are proposed to be imported <br />to the site. <br /> <br />That no blasting will be employed in the grading activity. <br /> <br />RESOLUTION #98-08-206 <br /> Page 1 of 3 <br /> <br /> <br />
