Councilmember Haas Steffen introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #98-08-210 <br /> <br />A RESOLUTION ADOPTING FINDING OF FACT #0470 RELATING TO A REQUEST <br />FROM DOUGLAS AND EVELYN BEHRENS FOR A CONDITIONAL USE PERMIT <br />FOR A PRIVATE DOG KENNEL TO MAINTAIN MORE THAN TWO ADULTS DOGS <br />ON A PARCEL OF PROPERTY. <br /> <br /> WHEREAS, the City of Ramsey received an application from Douglas and Evelyn <br />Behrens for a conditional use permit to maintain more than two adult dogs on the property <br />generally known as 5759 153rd Avenue N.W. and legally described as follows: <br /> <br />The west 165 feet of the Southeast Quarter of the Northeast Quarter of Section 23, <br />Township 32, Range 25, Anoka County, Minnesota, subject to road easement. <br /> <br />(the "Subject Property"). <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THIS CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA that the findings of fact relating <br />to the request are determined to be as follows: <br /> <br />That on July 20, 1998, Douglas and Evelyn Behrens, hereinafter referred to as "Applicants", <br />properly applied for a conditional use permit for a private dog kennel to maintain more than <br />two adult dogs on the Subject Property. <br /> <br />That the applicants appeared before the Ramsey Planning Commission for a public hearing <br />pursuant to Section 9.03.04 of the City Code on August 4, 1998, and that said public hearing <br />was properly advertised and that the minutes of said public hearing are hereby incorporated <br />as a part of these findings by reference. <br /> <br />3. That the Subject Property and parcels to the north, east and west are zoned R-1 Rural <br /> Residential; property on the south side of 153rd Avenue is zoned B-1 Business. <br /> <br />4. That the Subject Property is approximately 5 acres in size. <br /> <br />5. That Section 9.02 of the Ramsey City Code defines dog kennel as any place where three or <br /> more dogs over three months of age are kept. <br /> <br />6. That Section 9.20.11 (R-1 Rural Residential District) does not establish dog kennels as a <br /> permitted use of property in this District. <br /> <br />7. That the Applicants assumed ownership of the Subject Property on July 29,1998. <br /> <br /> <br />
