Councilmember Beahen introduced the following resolution and moved for its adoption: RESOLUTION #98-10-253 RESOLUTION APPROVING 1ST PARTIAL PAYMENT TO W.B. MILLER, INC. FOR THE 1998 STREET MAINTENANCE PROGRAM - DIVISION C - BITUMINOUS OVERLAYING (IMPROVEMENT PROJECT #98-08 THROUGH #98-12) AND DIVISION D - STREET RECONSTRUCTION OF URANIUM STREET IN BURNS TOWNSHIP WHEREAS, Resolutions/498-05-083 through #98-05-087 were adopted by Ramsey City Council on May 12, 1998, authorizing the preparation of plans and specifications for Improvement Project #98-08 through #98-12; and WHEREAS, Resolutions #98-06-120 through #98-06-124 were adopted by Ramsey City Council on June 9, 1998, approving the plans and specifications and authorizing the advertisement for bids for Improvement Project #98-08 through #98-12; and WHEREAS, on June 9, 1998, Council authorized by motion to include the street reconstruction of Uranium Street in Bums Township as Division D of the 1998 Street Maintenance Program, and to advertise for bids along with Division C; and WHEREAS, on August 11, 1998, the Ramsey City Council adopted Resolution #98-08- 171 awarding the bid to W.B. Miller, Inc. for Divisions C of the 1998 Street Maintenance Program; and WHEREAS, on August 11, 1998, the Ramsey City Council adopted Resolution #98-08- 172 awarding the bid to W.B. Miller, Inc. for the 1998 Street Maintenance Program - Division D -Street Reconstruction of Uranium Street in Bums Township; and WHEREAS, City Engineer Steve Jankowski has inspected the completed work and recommends payment to W.B. Miller, Inc. in the amount of $333,674.25. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: 1) That the City Council hereby authorizes partial payment to W.B. Miller, Inc. for the 1998 Street Maintenance Program - Division C - Bituminous Overlaying (Improvement Projects #98-08 through #98-12) and Division D - Street Reconstruction of Uranium Street in Bums Township in the amount of $333,674.25. 2) That the City Council hereby accepts the project and authorizes the Mayor or City Administrator to sign the release form for this payment. 3) That the total amount of this payment is not included in resolutions approving payment of bills for the month of October, 1998.
