Board Member Anderson introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #98-11-264 <br /> <br />RESOLUTION ADOPTING FINDINGS OF FACT #0478 RELATING TO A REQUEST <br />FOR A VARIANCE TO CONSTRUCT AN ACCESSORY STRUCTURE NEARER THE <br />FRONT PROPERTY LINE THAN THE PRINCIPAL STRUCTURE <br /> <br /> WHEREAS, Timothy J. Kaster and Anita M. Kaster, hereinafter referred to as <br />"Applicants," have properly applied for a variance from Section 9.11.02 of the Ramsey City <br />Code to construct an accessory building nearer the front property line than the principal structure <br />on the property generally known as 17765 Tonto Street NW and legally described as follows: <br /> <br />That part of Government Lot 1, Section 1, Township 32, Range 25, in Anoka County, <br />Minnesota described as follows: Commencing at a point on the East Line of said <br />Government Lot 1 a distance of 980.6 feet south of the intersection of the East Line of the <br />Northeast Quarter of the Northeast Quarter of said Section 1 and the center line of County <br />State Aid Highway No. 7 as it is now laid out and traveled; thence north 85 degrees 00 <br />minutes west a distance of 600 feet to the point of beginning of land to be described; <br />thence continuing north 85 degrees 00 minutes west on the same described line a distance <br />of 200 feet; thence south 2 degrees 24 minutes east a distance of 335.85 feet; thence 89 <br />degrees 13 minutes 51 seconds east a distance of 185.19 feet; thence north (assumed <br />bearing) and parallel with the East Line of said Government Lot 1 a distance of 315.63 <br />feet to the point of beginning (subject to easement for road purposes over the north 33 <br />feet thereof and over the west 33 feet thereof) and also (subject to a power easement over <br />the south 75 feet thereof). <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF ADJUSTMENT OF THE <br />CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />That the Board of Adjustment conducted a public hearing pursuant to Section 9.03.05 of the <br />Ramsey City Code on November 2, 1998, and that said public hearing was properly <br />advertised, and that the minutes of said public hearing are hereby incorporated as a part of <br />these findings by reference. <br /> <br />2. That the subject property is zoned R-1 Rural Residential and is approximately 1 acre in size. <br /> <br />3. That the subject property is surrounded by R-1 Rural Residential zoning developed with <br /> single family homes. <br /> <br />4. That Section 9.11.02 of the Ramsey City Code does not permit the construction of accessory <br /> structures nearer the front property line than the principal structure. <br /> <br />5. That the principal structure on the subject property is approximately 60 feet from the front <br /> property line. <br /> <br />6. That the Applicants are proposing to construct a 12' x 16' utility shed approximately 35 feet <br /> from the front property line. <br /> <br /> <br />
