Councilmember Beahen introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION//98-11-287 <br /> <br />RESOLUTION AUTHORIZING ACQUISITION OF PROPERTY FOR WETLAND <br />MITIGATION PURPOSES. <br /> <br />WHEREAS, State law requires wetland mitigation when wetland are filled; and <br /> <br /> WHEREAS, the City has a need to create additional wetlands because of certain <br />economic development within the City; and <br /> <br /> WHEREAS, the City finds it necessary to acquire fee title to the real property described <br />below in order to use said property for wetland mitigation; and <br /> <br /> WHEREAS, the City has authority to acquire the real property for the public purpose of <br />wetland mitigation by eminent domain pursuant to Minn. Stat. Chapter 117; and <br /> <br /> WHEREAS, the City has the right to acquire the real property prior to the filing of an <br />award by the Court appointed commissioners, pursuant to Minn. Stats. §117.011 and § 117.042; <br />and <br /> <br />WHEREAS, the real property which needs to be acquired is legally described as follows: <br /> <br />That part of the Southwest Quarter of the Northeast Quarter of Section 27, Township 32, <br />Range 25, Anoka County, Minnesota, lying southwesterly of the southwesterly line of <br />Anoka County Highway Right of Way Plat No. 8, according to the recorded plat thereof. <br /> <br /> The parcel which is impacted by the taking identified above have the following Anoka <br />County PIN: <br /> <br />Part of PIN: 27-32-25-13-0001 <br /> <br /> WHEREAS, the fee owner of the real property which needs to be acquired is identified <br />as WASTE MANAGEMENT OF MINNESOTA, INC. <br /> <br /> NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE <br />CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />That the City Administrator is hereby directed to acquire the real property as described <br />above in accordance with Minnesota Statutes. The City Administrator is authorized to <br />negotiate and represent the City of Ramsey in all proceedings. <br /> <br />That if the real property as described above cannot be acquired by direct negotiation, it <br />shall be acquired by eminent domain. <br /> <br /> <br />
