Councilmember Haas Steffgen introduced the following resolution and moved for its adoption: <br /> RESOLUTION NO. 99-03-052 <br /> A RESOLUTION APPROVING THE ISSUANCE OF A CONDITIONAL USE PERMIT <br /> BASED ON FINDINGS OF FACT #0487 AND DECLARING TERMS OF PERMIT TO <br /> EXCEED THE TOTAL AMOUNT OF ACCESSORY STRUCTURE SPACE ALLOWED ON <br /> A PARCEL OF LAND, AND THE SINGLE BUILDING AREA AND HEIGHT <br /> RESTRICTIONS <br /> WHEREAS, the Ramsey City Council adopted Resolution No. 98-03-051 adopting <br /> Findings of Fact #0487 for this use and herein approves the Conditional Use Permit subject to the <br /> following conditions. <br /> NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br /> RAMSEY, ANOKA COUNTY,STATE OF MINNESOTA, as follows: <br /> On March 23, L999, a Conditional Use Permit ("CUP") was issued by the City of Ramsey <br /> ("City") to Gregory Landowski ("Permittee") for an overage in total accessory structure space, and <br /> single building area and height restrictions on the property generally known as 6131 Green Valley <br /> Road and legally described as follows: <br /> Lot 10 and 10A, Block 1, Green Valley Estates 2°d Addition, Anoka County, Minnesota <br /> ("Subject Property") <br /> This permit is issued pursuant to Section 9.03.04 and 9.11.02 of the Ramsey City Code. The <br /> conditions of this permit are as follows: <br /> 1. That this resolution shall allow for the construction of a 13,200 square foot indoor riding <br /> arena ("Structure') on the Subject Property. Said Structure is approved for construction with <br /> 29 gauge steel panels,color matched to the home. <br /> 2. The Permittee shall obtain all necessary permits prior to commencing any construction of the <br /> Structure. <br /> 3. That no commercial or industrial activity of any type shall be permitted in said Structure <br /> unless the necessary permits have been obtained from the City of Ramsey. <br /> 4. That the Permittee shall be responsible for all City costs incurred in administering and <br /> enforcing this conditional use permit. <br /> 5. That the Permittee herein agrees to remedy a justifiable nuisance complaint resulting from <br /> the horse related activities on the property within a 24 hour period. The City Administrator <br /> or his/her designee shall have the authority to determine whether a nuisance complaint is <br /> justified or not. <br />
