Councilmember Anderson introduced the following resolution and moved for its adoption: RESOLUTION #99-04-068 A RESOLUTION ADOPTING FINDING OF FACT #0490 RELATING TO A REQUEST FROM T.V. RAO FOR A CONDITIONAL USE PERMIT TO ALTER THE LANDSCAPE ON A PARCEL LOCATED IN THE RUM RIVER SCENIC OVERLAY DISTRICT WHEREAS, the City of Ramsey received an application from T.V. Rao for a conditional use permit for landscape alterations on the property generally known as 14359 Waco St. N.W. and legally described as follows: Lot 40, Block 6, River's Bend, Anoka County, Minnesota (the "Subject Property") NOW THEREFORE, BE IT RESOLVED BY THIS CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA that the findings of fact relating to the request are determined to be as follows: That Chapter 9, Section 9.23.10, Subd. 2 (Zoning and Subdivision of Land; Scenic River; Landscape Alterations; Grading, Filling, Alterations of the Bed of Public Waters) states that any grading and filling work done within the Scenic River Overlay District shall require a permit. o That on March 19, 1999, T.V. Rao, hereinafter referred to as "Applicant", properly applied for a conditional use permit to regrade the riverbank and install rip rap on the Subject Property, which is located in the Rum River Scenic Overlay District, as a result of being informed by City Staff that work had commenced without benefit of the proper permits. That the Applicant's submittal consists of five (5) sheets which include: Exhibit A (1988- 1998 Erosion Evidence), Exhibit B (High Water Photo), Exhibit C (Project Plan), Exhibit D (Landscape Proposal Aerial View), Exhibit E (Landscape Proposal River View). That the Applicant appeared before the Ramsey Planning Commission for a public hearing pursuant to Section 9.03.04 of the City Code on April 6, 1999, and that said public hearing was properly advertised and that the minutes of said public hearing are hereby incorporated as a part of these findings by reference. 5. That the Applicant's proposal consists of an erosion control plan that includes reducing the slope of the bluff and installing rip rap and plant materials to stabilize the bluff. 6. That the Applicant has stated that there will be no soils exported from or imported to the Subject Property.
