Councilmember Zimmerman introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION//99-05-093 <br /> <br />A RESOLUTION ADOPTING FINDINGS OF FACT #0493 RELATING TO A <br />REQUEST FROM DENNIS AND BONITA COBEY FOR A HOME OCCUPATION <br />PERMIT FOR A COMMERCIAL CATTERY. <br /> <br /> WHEREAS, the City of Ramsey received an application from Dennis and Bonita Cobey <br />for a home occupation permit to establish and operate a commercial cattery on the property <br />generally known as 9340 Hwy. #10 N.W. and legally described as follows: <br /> <br />East 132 Feet of Lot 6, Auditor Subdivision 33, of Anoka County, Minnesota. <br /> <br />(the "Subject Property"). <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THIS CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA that the findings of fact relating <br />to the request are determined to be as follows: <br /> <br />That on April 12, 1999, Dennis and Bonita Cobey, hereinafter referred to as "Applicants", <br />properly applied for a home occupation permit for a commercial cattery on the Subject <br />Property. <br /> <br />That the applicants appeared before the Ramsey Planning Commission for a public hearing <br />pursuant to Section 9.11.04 of the City Code on May 4, 1999, and that said public hearing <br />was properly advertised and that the minutes of said public hearing are hereby incorporated <br />as a part of these findings by reference. <br /> <br />3. That the Subject Property is zoned B-1 Business but is subject to R-1 Residential regulations <br /> as the principal use of the property is a dwelling. <br /> <br />That the adjacent property to the west and the property on the north side of Hwy. #10 is also <br />zoned B-1 Business; the property to the east is the State Wayside Park; and the Subject <br />Property is bounded on the south by the Mississippi River. <br /> <br />5. That the Subject Property is approximately 3.7 acres in size. <br /> <br />6. That home occupations are restricted to 20% of the gross floor area of the home which in this <br /> case is 920 square feet (20% of 4,600 square feet). <br /> <br />7. That the Applicants raise, breed and sell Persian and Himilayan cats and are proposing to <br /> have a maximum of 24 cats, 16 weeks of age and older, on the property at any given time. <br /> <br />8. That the Applicants have stated that the cattery is an operation that is operated entirely <br /> indoors and the area of the home devoted to the business is 350 square feet. <br /> <br /> <br />
