1443619 !q.3o2 · - 0004 Coun¢ilmember Hendr|ksen introduced the following resolution and moved for its adoption: RESOLUTION NO. 99-05-094 A RESOLUTION APPROVING THE ISSUANCE OF A HOME OCCUPATION PERMIT BASED ON FINDINGS OF FACT #0493 AND DECLARING TERMS OF PERMIT FOR A COMMERCIAL CATTERY. WHEREAS, the Ramsey City Council adopted Resolution No. 99-05-094 adopting Findings of Fact #0493 for this use and herein approves the Home Occupation Permit subject to the following conditions. NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: On May 25, 1999, a Home Occupation Permit ("Permit") was issued by the City of Ramsey ("City") to Dennis and Bonita Cobey ("Permittee") for a commercial cattery on the property generally known as 9340 Hwy. #10 N.W. and legally described as follows: The East 132 Feet of Lot 6, Auditor Subdivision 33, of Anoka County, Minnesota. ("Subject Property"). This Permit is issued pursuant to Section 9.11.04 of the Ramsey City Code. The conditions of this Permit are as follows: This Permit shall remain in effect so long as the conditions imposed herein are complied with. Should the Permittee die or move to a new location, the existing Permit shall be automatically terminated, except that a surviving child, residing at the same address, or the subsequent property owner, desiring to continue the Permit, shall submit written notice to that effect to the Administrator and the Council may authorize continuation of the Permit without further hearing. This Permit shall allow for the maintenance of a maximum of twenty-four (24) cats, sixteen (16) weeks of age and older, on the Subject Property and the cattery shall be primarily an indoor operation. o Upon confirmation of any nuisance complaints relating to the operation of the cattery, the City may take action to abate the nuisance and/or to revoke this Permit pursuant to Section 9.03.04, subd. 9, of the Ramsey City Code.
