Board Member Johnson introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #99-06-101 <br /> <br />RESOLUTION ADOPTING FINDINGS OF FACT #0495 RELATING TO A REQUEST <br />FOR A VARIANCE FROM THE SIDE YARD SETBACK REQUIREMENT IN THE <br />RURAL RESIDENTIAL DISTRICT <br /> <br /> WHEREAS, Michael and Robin Gobernatz, hereinafter referred to as "Applicants," have <br />properly applied for a variance from Section 9.20.11 of the Ramsey City Code to construct a <br />garage that will encroach on the established side yard setback on the property generally known as <br />5900 177th Avenue N.W. and legally described as follows: <br /> <br />Lot 2, Block 1, Gobematz Addition, Anoka County, Minnesota. <br /> <br />(the "Subject Property") <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF ADJUSTMENT OF THE <br />CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />That the Board of Adjustment conducted a public heating pursuant to Section 9.03.05 of the <br />Ramsey City Code on June 1, 1999, and that said public hearing was properly advertised, and <br />that the minutes of said public hearing are hereby incorporated as a part of these findings by <br />reference. <br /> <br />2. That the subject property is zoned R-1 Rural Residential and is 2.5 acres in size. <br /> <br />3. That the subject property is surrounded by R-1 Rural Residential zoning developed with <br /> single family homes. <br /> <br />4. That Section 9.20.11 of the Ramsey City Code establishes a 10 foot side yard setback in the <br /> Rural Residential District. <br /> <br />5. That the Applicants are proposing to construct a garage approximately six (6) feet from the <br /> west side property line. <br /> <br />That there are special conditions applying to the Subject Property that do not generally apply <br />to other properties in the district; namely the side and rear yards contain sharply declining <br />topography, drainfield, and alternative drainfield location. <br /> <br />7. That there is a limited amount of space remaining on the garage side of the principal building <br /> for an additional garage before encountering the sharp decline in topography. <br /> <br />8. That the special conditions do not result from the actions of the Applicants. <br /> <br /> <br />
