Councilmember Anderson introduced the following resolution and moved for its adoption. RESOLUTION #99-06-110 RESOLUTION AUTHORIZING ACQUISITION OF PROPERTY FOR STATE TRUNK HIGHWAY #47 IMPROVEMENT PURPOSES WHEREAS, the City and State of Minnesota propose to improve State Trunk Highway #47 (the "Public Improvement"); and WHEREAS, the Public Improvement consists of realigning and reconstructing said roadway as herein determined necessary to provide for the safety of the traveling public; and WHEREAS, permanent and temporary easements over certain lands are required to provide for said construction and Public Improvement; and WHEREAS, easements; and the City has the responsibility to acquire the right-of-way WHEREAS, the City has the authority to acquire real property for Public Improvements by eminent domain pursuant to Minnesota Statutes Chapter 117 and pursuant to City Charter; and WHEREAS, the City has the right to acquire the real property prior to the filing of an award by the Court appointed commissioners, pursuant to Minnesota Statutes 117.011 and 117.042; and WHEREAS, the real property which needs to be acquired for State Highway #47 improvement purposes described above is legally described as follows: See attached Exhibit "A" WHEREAS, the property owner of the real property which needs to be acquired has been identified by the City as follows: See attached Exhibit "A" NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: That the City Administrator is hereby directed to acquire the real property as described above in accordance with Minnesota Statutes. The City Administrator is authorized to negotiate and represent the City of Ramsey in all proceedings.
