Councilmember Anderson introduced the following resolution and moved for its <br />adoption. <br /> <br />RESOLUTION #99-06-110 <br /> <br />RESOLUTION AUTHORIZING ACQUISITION OF PROPERTY FOR STATE <br />TRUNK HIGHWAY #47 IMPROVEMENT PURPOSES <br /> <br /> WHEREAS, the City and State of Minnesota propose to improve State Trunk <br />Highway #47 (the "Public Improvement"); and <br /> <br /> WHEREAS, the Public Improvement consists of realigning and reconstructing <br />said roadway as herein determined necessary to provide for the safety of the traveling <br />public; and <br /> <br /> WHEREAS, permanent and temporary easements over certain lands are required <br />to provide for said construction and Public Improvement; and <br /> <br /> WHEREAS, <br />easements; and <br /> <br />the City has the responsibility to acquire the right-of-way <br /> <br /> WHEREAS, the City has the authority to acquire real property for Public <br />Improvements by eminent domain pursuant to Minnesota Statutes Chapter 117 and <br />pursuant to City Charter; and <br /> <br /> WHEREAS, the City has the right to acquire the real property prior to the filing <br />of an award by the Court appointed commissioners, pursuant to Minnesota Statutes <br />117.011 and 117.042; and <br /> <br /> WHEREAS, the real property which needs to be acquired for State Highway #47 <br />improvement purposes described above is legally described as follows: <br /> <br />See attached Exhibit "A" <br /> <br /> WHEREAS, the property owner of the real property which needs to be acquired <br />has been identified by the City as follows: <br /> <br />See attached Exhibit "A" <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE <br />CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />That the City Administrator is hereby directed to acquire the real property as <br />described above in accordance with Minnesota Statutes. The City Administrator <br />is authorized to negotiate and represent the City of Ramsey in all proceedings. <br /> <br /> <br />
