Councilmember Hendriksen introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION//99-06-119 <br /> <br />RESOLUTION APPROVING THE ISSUANCE OF AN ENVIRONMENTAL PERMIT <br />BASED ON FINDINGS OF FACT//0498 AND DECLARING TERMS OF PERMIT TO <br />REGRADE THE BLUFF IN THE CRITICAL AREA AND SCENIC RIVER SECTION <br />OF THE MISSISSIPPI RIVER <br /> <br /> WHEREAS, the Ramsey City Council adopted Resolution No. 99-06-119 adopting <br />Findings of Fact #0498 for this use and herein approves the Environmental Permit subject to the <br />following conditions. <br /> <br />NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />On June 22, 1999, an Environmental Permit ("Permit") was issued by the City of Ramsey <br />("City") to Jim and Kathy Weidenbach ("Permit Holder") for landscape alterations on the <br />property legally described as follows: <br /> <br />Lot 7, Block 1, Bower's Mississippi Acres 3ra Addition, Anoka County, Minnesota. <br /> <br />("Subject Property:") <br /> <br />This permit is issued pursuant to Section 9.21 (Enviromnental Protection) and 9.23 (Scenic <br />River) of the Ramsey City Code. The conditions of this permit are as follows: <br /> <br />That the Permit Holder shall engage the services of a certified, licensed, or degreed landscape <br />architect to develop a Landscape Plan, taking into consideration transmittals from DNR Area <br />Hydrologist Tom Hovey dated March 16, 1998 and May 27, 1999 (attached hereto as <br />Exhibits A and B respectively), to restore the shoreline, rip rap slope and top of bluff with <br />native plants, trees and grasses compatible with the local landscape and climatic conditions. <br />Said Landscape Plan is subject to the approval of the City and shall be submitted by July 31, <br />1999. Any objection to the submitted landscape plan must be provided to the permit holder <br />in writing within 10 days of receipt or the plan shall be deemed approved. <br /> <br />That during the period of development and implementation of an approved landscape plan, <br />temporary ground cover shall be utilized to prevent erosion and trap sediment. The <br />temporary erosion control methods shall be identified on the approved Landscape Plan. <br /> <br />3. City staff will set a restoration completion date upon receipt of an acceptable landscape plan. <br /> <br />Failure to prepare the Landscape Plan and install the plantings by the dates specified shall be <br />a violation of the Permit and will result in a fine of $500.00/day until the work is completed <br />to the satisfaction of the City. <br /> <br /> <br />
