Councilmember Hendricksen introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #99-08-141 <br /> <br />A RESOLUTION ADOPTING FINDINGS OF FACT #0502 RELATING TO A <br />REQUEST TO SUBDIVIDE PROPERTY IN SECTION 1, TOWNSHIP 32, RANGE 25 <br />BY METES AND BOUNDS DESCRIPTION <br /> <br /> WHEREAS, the City received an application to subdivide property in accordance with <br />Section 9.50.05 (Minor Plat Procedure) of the Ramsey City Code. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />That on March 22, 1999, Ronald and Jacqueline Danner, hereinafter referred to as <br />"Applicants," properly applied for a Minor Plat to subdivide property generally known as <br />17400 Erkium St. N.W. and legally described as follows: <br /> <br />All that part of Government Lot 4, Section 1, Township 32, Range 25, Anoka County, <br />Minnesota, lying north of Trott Brook running through said Government Lot 4. <br /> <br />(the "Subject Property") <br /> <br />2. That the Subject Property is approximately 27 acres in size, zoned R-1 Rural Residential, and <br /> is occupied by the Applicants dwelling. <br /> <br />3. That the surrounding parcels are also zoned R-1 Rural Residential. <br /> <br />That the Subject Property has no direct access to a public road and is served by a private <br />driveway easement across the adjacent 40 acre parcel to the north that connects with Erkium <br />Street N.W. <br /> <br />That the Applicants submitted a Minor Plat sketch plan to subdivide the Subject Property into <br />one 4 acre homestead to facilitate the sale of the dwelling, and one 23 acre outlot for future <br />development, that included dedication of right-of-way for a future public road, but <br />maintained use of the private driveway easement for access purposes until such time as <br />further subdivision and development occurs. <br /> <br />6. That the Subject Property is in the Scenic River Overlay District and the proposed <br /> subdivision complies with the minimum lot area requirements of that District. <br /> <br />That the Applicants sketch plan was presented to the Planning Commission on May 4, 1999, <br />and the Commission recommended City Council approval of the subdivision, with <br />affirmation that the subdivision would not permit the development of any additional homes <br />on the Subject Property without replatting the outlot and construction of a public road to City <br />standards to access the property. <br /> <br />8. That the existing private driveway easement is non-exclusive and runs with the land. <br /> <br /> <br />
