5. That the principal structure on the subject property is approximately 138 feet from the front <br /> property line. <br /> <br />6. That the Applicants are proposing to construct a garage approximately 127 feet from the front <br /> property line. <br /> <br />7. That the City Code allows for a total of 2,064 square feet of garage and accessory buildings <br /> on the Subject Property. <br /> <br />8. That the existing attached garage is 520 square feet; the existing storage shed is 150 square <br /> feet; and the proposed garage is 864 square feet in size, for a total of 1,534 square feet. <br /> <br />o <br /> <br />That there are special conditions applying to the Subject Property that do not generally apply <br />to other properties in the district; namely the side and rear yard contain sharply declining <br />topography, mature tree growth, and access to the septic system. <br /> <br />10. That the special conditions do not result from the actions of the Applicants. <br /> <br />11. That literal interpretation of the provisions of City Code would deprive the Applicants of <br /> rights commonly enjoyed by other properties in the same district, namely the right to increase <br /> the amount of garage space on the Subject Property. <br /> <br />12. That the variance requested is the minimum variance which would alleviate the hardship. <br /> <br />13. That if granted, the variance will not permit a use that is prohibited in the R-1 Rural <br /> Residential District. <br /> <br />14. That if granted, the variance will not impair an adequate supply of light and air to adjacent <br /> property. <br /> <br />15. That if granted, the variance will not unreasonably increase the congestion in the public <br /> street. <br /> <br />16. That if granted, the variance will not increase the danger of fire or endanger the public safety. <br /> <br />17. That if granted, the variance will not unreasonably diminish property values in the <br /> neighborhood. <br /> <br />18. That if granted, the variance will not violate the intent of the Comprehensive Plan. <br /> <br />19.
