ENCROACHMENT AGREEMENT <br /> THIS AGREEMENT ("Agreement") is made this 27th day of August, 2024, by and <br /> between the CITY OF RAMSEY, a municipal corporation under the laws of the State of <br /> Minnesota ("City"), and Curtis Forster and Noelle Forster, and their successors and assigns <br /> ("Landowners"). <br /> RECITALS: <br /> WHEREAS, Landowners are the fee owner of the real property located at 6960 148th Ln <br /> NW, Ramsey, Minnesota, and legally described as follows: <br /> Lot 2, Block 6, Regency Ponds 3rd Addition,Anoka County, Minnesota <br /> ("Property"); and <br /> WHEREAS, the City currently has five (5) foot wide Drainage and Utility Easement <br /> ("Easement")over,under and across the western portion of the Property, as dedicated to the public <br /> pursuant to the Plat known as "REGENCY PONDS 3RD ADDITION" recorded in the Office of <br /> the County Recorder, Anoka County, Minnesota; and <br /> WHEREAS, Landowners seek permission from the City to partially encroach upon the <br /> Easement for a partially enclosed lean-to structure with a concrete pad measuring 19-feet 10-inches <br /> by 28-feet. <br /> NOW, THEREFORE, in consideration of the mutual covenants contained herein and <br /> other good and valuable consideration, the parties agree as follows: <br /> 1 <br />
