<br />( <br /> <br />Rita Hoeschen - My n':1 ~hbors and I received one letter regarding locating <br />a T.V. tower at the Morris property and a date or recognizable location was <br />not mentioned. <br /> <br />Mr. Schnelle provided Council with a copy of the "Notice of Public Hearing" <br />and a date and address were given and Mrs. Hoeschen was on the distribution <br />1 i st. <br /> <br />Carol Sather - We were under the impression the Voigt property was being <br />discussed, not the Morris property. <br /> <br />Mrs. Hoeschen - If the tower is approved on the Morris property, do we, <br />as residents, have any recourse. <br /> <br />Mayor Gamec replied that they could take the City to court. <br /> <br />Motion by Councilmember Sorteberg and seconded by Councilmember Van Wagner ~o <br />adopt the Findings of Fact for Group W Cable's variance request. JfL :J_VYCotu<\.cfl tt <br />JCL(~J ~o5b <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Sorteberg, Schlueter, <br />Van Wagner. Voting No: None. Absent: Councilmember Reimann. <br /> <br />Motion by Mayor Gamec to adopt Resolution #83-10 to enter into a development <br />agreement with Group W Cable. Further, that the following conditions be <br />added to that agreement: (Please refer to resolution file for Res. #83-10). <br /> <br />1. That the tower-have no additional dishes placed on it. <br /> <br />, <br />(-. I" <br /> <br />2. That no flashing lights be placed on it, if not required by FAA. <br /> <br />3. That the structure have a 8' high fence around it. <br /> <br />Further Discussion: Mr. Berg noted that P & Zirecommendation was not to <br />require fencing, that doing so might leave the City open to liable charges. <br />Mr. O'Connell stated that a fence is not a deterrent to anyone who really <br />wants to trespass. Mayor Gamec and Councilmember Sorteberg are still in <br />favor of requiring fencing. Mayor Gamec stated that the fencing requirement <br />will remain in the motion. <br /> <br />4. That the maximum height of the tower will be 110'. <br /> <br />5. That along the west side of Hwy. 5 screening be placed, such as <br />trees, at 8' intervals. <br /> <br />Further Discussion: Councilmember Van Wagner requested adding the condition <br />that the tower be constructed without guy lines. Mr. O'Connell replied that <br />the construction of a tower without guy lines involves a base of 16'-18' <br />across and a tower with guy 1 i nes i nvo 1 ves a base of about 30" across. <br />Council consensus is to proceed with a t~wer constructed with guy lines. <br /> <br />(City Attorney Goodrich arrived at 10:13 P.M.) <br /> <br />Councilmember Sorteberg seconded the motion. <br /> <br />I <br />" <br /> <br />Rita Hoeschen - Could screening also be placed along the Titterud side of <br />the property. <br /> <br />CjFebruary 22, 1983 <br />Page 12 of 21 <br /> <br />, <br />/ <br />
