with reasonable care to avoid damage, shall replace all containers in an upright position and shall immediately clean up and dispose of any contents thereof which have spilled or leaked. E. The performance of the contract shall be done by Contractor with forces which are adequate to insure the satisfactory collection and disposal of the recyclable materials at all times. Contractor's failure to perform shall not be excused by adverse conditions of weather, breakdown and similar hindrances which on other work might be regarded as "acts of providence". 7. COMPENSATION A. The city will compensate the Contractor for the collection of recyclable materials from the pilot Project Area. The city will pay to contractor, on a monthly basis, a sum equivalent to $1.01 for each residence from which recyclable materials were collected as substantiated by monthly billings of the Contractor. 8. FILING OF REPORTS A. Thel Contractor shall submit a monthly summary of the participating residences, and quantity and kinds of all recyclable materials collected and the primary purchaser(s) of the recyclable materials. Monthly summaries shall be submitted no later than the 15th day ,!f ,the ,month following the month for which the report ~s subm~tted. I B. The Contractor shall furnish to the city throughout the term of contract a quarterly financial report detailing the: expenses and revenues of the recycling program. ACCESS TO RECORDS I The Contractor shall permit the city to review its books, documents, papers, records and/or financial records which are directly related to the performance of this contract for the purpose of making an audit, other examination and/or preparing excerpts and transcriptions. 10.
