<br />I <br /> <br />I <br /> <br />PROPOSED <br />FINDINGS OF FACT <br />MR. JEFFREY PORUPSKY <br /> <br />I <br /> <br />1) That the Applicant has properly applied for a conditional use permit as required <br />by City Ordinance to maintain a private kennel. <br /> <br />I <br /> <br />2) That the Applicant appeared before the Planning and Zoning Commission for a <br />public hearing pursuant to the City Zoning Ordinance on December 6, 1983. That <br />said public hearing was properly advertised and the minutes of that public hearing <br />are hereby incorporated by reference. <br /> <br />I <br /> <br />I <br /> <br />3) That the Standards for Consideration are as follows: <br /> <br />a) The property is zoned R-l and this is not a permitted use. <br /> <br />I <br /> <br />b) The adjoining properties are residential dwellings located on approximately <br />one acre wooded parcels on all sides. <br /> <br />I <br /> <br />c) The closest similar use is approximately one mile which is a commercial kennel. <br /> <br />d) There will be no change in traffic flow to the area. <br /> <br />I <br /> <br />e) There are four known kennels in operation in the City which to our knowledge <br />have not caused neighborhood problems. However, there are numerous individuals <br />that should have conditional use permits for private kennels that do cause 'problems <br />because of a lack of proper facilities to control animals. <br /> <br />I <br /> <br />I <br /> <br />f) Properly maintained, the kennel will not affect the lifestyle of the neighboring <br />residents in a rural setting. Further, it should not affect the enjoyment or value <br />of properties in the vicinity. <br /> <br />I <br /> <br />4) That the Criteria for Approval/Disapproval are as follows: <br /> <br />I <br /> <br />a) The Applicant's request is to keep three adult dogs and that properly maintained <br />this should not be detrimental to or endanger the public health, safety or general <br />welfare and is not contrary to established standards as regulated by City Codes. <br /> <br />I <br /> <br />b) The lot size and proposed kennel location should not be unsightly or undesirable <br />or obnoxious in appearance and it should not hinder the orderly and harmonious <br />d"velopment of the City or the district where herein proposed. <br /> <br />I <br /> <br />c) Adequate water supply and sewage disposal facilities will be provided. <br /> <br />I <br /> <br />d) The use will conform to the regulations of R-l, residential, zoning except that <br />a conditional use permit is required. <br /> <br />5) That the Performance Standards are as follows: <br /> <br />I <br /> <br />a) Fire protection is provided by the City of Anoka, however, the dog kennel <br />should not create a fire hazard. <br /> <br />I <br /> <br />b) Electrical disturbances are not applicable. <br /> <br />c) Vibntion will not be applicable. <br /> <br />I <br />
