The City Engineer <br />has <br />i <br />recommended a penalty be assessed for failure to ocrnplete the job <br />on time. His recommendation is for a 17 day <br />penalty in the amount of <br />$300.00 per day. the contractor was actually 25 days late but credit <br />for <br />' <br />rain days, etc. was considered. <br />We concur with the City Engineer's estimate and would recommend final <br />payment on this contract, assessing a <br />i <br />penalty in the amount of <br />$5,100.00. <br />' <br />Enclosure (D2 -b) contains the following information which is <br />sutmitted for your consideration: <br />a) City Engineer's pay estimate dated August 21, 1985 <br />' <br />b) City Engineer's letter dated August 22, 1985 <br />c) Proposed resolution authorizing final payment <br />' Council <br />Action <br />Your action will be to approve/disapprove of this request.
