I
1
1
1
ti.
.r'NNl fO
Office of
ANOKA COUNTY ATTORNEY
ROBERT M.A. JOHNSON
Courthouse - Anoka, Minnesota 55303 612.421 -4760
August 13, 1985
William Goodrich
Attorney at Law
320 East Main Street
Anoka, Minnesota 55303
Re: Vacation of Old C.S.A.H. #5
Dear Bill:
This letter if to inform you of a situation existing at the intersection of C.S.A.H. #5 and
157th lane N.W. in the City of Ramsey. There is a parcel of tax - forfeited property on the
northeasterly side of C.S.A.1I. #5 which will be sold at a private sale to adjoining
' landowners. An easement for Old C.S.A.H. #5 lies across a portion of this tax - forfeited
property (a diagram indicating this situation is attached). The County would like to
revoke the C.S.A.11. designation of this easement pursuant to Minn. Stet. 162.02, subd. 10
and quit claim it to the City of Ramsey. The City could then vacate the easement and
give the land to the adjoining landowners. Once the vacation occurs, the County will split
the tax- forfeited land into two parcels and will sell each to those adjoining landowners.
The two tax - forfeited parcels will then be combined with both the vacated property and
' the adjoining owners' other property to form an enlarged tax parcel.
I am asking you to have the City of Ramsey consider at its August 27, 1985, city council
meeting whether it will vacate Old C.S.A.H. #5 if the County will revoke its county state
aid highway designation. If the City will vacate, would you please see that a resolution,
requesting the County to revoke so that the City may vacate, is presented to the City
Council. If passed, please forward that to me and I will then attach the City's resolution
to the County's resolution to revoke.
If you have questions about this, please call me at 421 -4760, extension 1268. Thank you
for your help.
Sincerely yours,.
h e. P6I CJalumbo
Assistant County Attorney
ACP:kh
attachment
CC: Commissioner Natalie A.
