Councilmember moved the adoption of the following <br />findings of fact: <br />FINDINGS OF FACT 0120 <br />M. DONALD NESS <br />1. That the Applicant has applied for a Board of Adjustment <br />variance to construct an accessory structure larger than allowed <br />by City Code. <br />2. That the Applicant appeared before the Board of Adjustment <br />for a public hearing on August 27, 1985, and that said public <br />hearing was properly advertised and that the minutes of said <br />public hearing are hereby incorporated as a part of these <br />findings by reference. <br />3. That the Applicant's property is generally known as 7735 <br />156th Avenue N.W. and is located in the R -1 Residential District. <br />4. That the subject property is approximately 2 acres in size. <br />5. That the Applicant's request is to construct a 26' x 30' <br />accessory structure with a total area of 780 square feet. The <br />structure is proposed to be used for the storage of materials, <br />equipment, and vehicles used by the Applicant in his home <br />improvement business. <br />6. That the City Code restricts the total square footage of an <br />accessory structure to 624 square feet on parcels of land less <br />than 2 -1/2 acres. <br />7. That the Applicant has also applied for a conditional use <br />permit to operate his home improvement business from his <br />residence. <br />8. That the Applicant appeared before the Planning and Zoning <br />Commission for a public hearing on the request for a conditional <br />use permit to operate a home occupation on August 12, 1985, and <br />that said public hearing was properly advertised and that the <br />minutes of said public hearing are hereby incorporated as a part <br />of these findings by reference. <br />9. That the Planning and Zoning Commission recommended to <br />approve the Applicant's request for a conditional use permit to <br />operate a home occupation. <br />10. That there may be exceptional, unique or extraordinary <br />circumstances or conditions applying to the property in question <br />as to the intended use of the property that do not apply <br />generally to other properties in the same zoning district. <br />11. That such variance may be necessary for the preservation and <br />-1- <br />
