<br />dNDIOOS OF FACT <br />OIARLES PEARSOO <br /> <br />1. 1hat Mr. Charles Pearson, hereinafter referred to as -Applicant,- has <br />properly applied for a conditional use permit to operate an auto body repair <br />service business in the I-I Industrial District. <br /> <br />2. 'Ihat the Applicant aweared before the Planning Commission for a public <br />hearing p.1rsuant to City Code on February 19, 1986 and that said p.1blic hearing <br />was properly advertised and minutes of that public hearing are hereby <br />incorporated ~ reference. <br /> <br />3. 'Ihat the property which is the subject of the application is located at <br />14059 Sunfish Lake Boulevard N.W. and is legally described as follows: <br /> <br />'Ihe West 169.41 feet of Tract C of Registered Land Survey No. 30 excluding <br />roaciiay, subject to easements of record, Anoka County, Minnesota. <br /> <br />4. 'Ihat the subject parcel is approximately 1.1 acres in size and is located <br />in the I-I Industrial District. <br /> <br />5. 'Ihat the Standards for Consideration are as follows: <br /> <br />a. 'Ihat the property is zoned I-I and an auto body repair service is not a <br />permitted use in this zone; <br /> <br />b. 'Ihat the adjoining property is either vacant or industrially utilized; <br /> <br />c. 'Ihat there is not another similar use in the I-I Industrial District; <br /> <br />d. 'Ihat there would be no significant mange in the traffic flow to the <br />area; <br /> <br />e. 'Ihat there are other similar uses, auto body repair services, in the <br />City, and <br /> <br />f. 'Ihat the proposed use will not be detrimental to persons residing or <br />working in the vicinity of the use or the general public and will not <br />substantially impair the enjoyment or value of properties in the area. <br /> <br />6. 'Ihat the Criteria for Approval/Disawroval are as follows: <br /> <br />a. 'Ihat the Applicant's request to operate an auto body repair service in <br />the I-I Industrial District will not be detrimental to or endanger the <br />p.1blic health, safety or general welfare and is not contrary to other <br />governnental standards or regulations, <br /> <br />b. 'Ihat the proposed use will not be unsightly or undesi reablye or <br />obnoxious in appearance and it will not hinder the oderly and <br />harmonious development of the I-I Industrial District; <br /> <br />c. 'Ihat adequate on-site parking and drainage will be provided, and <br /> <br /> <br />....- <br />
