<br />FIKDIRGS OF FACT <br />10RTBSTAR OUTDOOR IDUCATIOR, IIC. <br /> <br />1. That Mr. Jeff Stedman of Northstar Outdoor Education, Inc.. hereinafter <br />referred to as "Applicant." baa properly applied for a conditional use permit <br />to operate a canoe/tube rental and abutt1e service from tbe Anoka County Rum <br />River Central Park. <br /> <br />2. That tbe Applicant appeared before tbe Planning and Zoning Commission for a <br />public bearing pursuant to Section 170.07 of tbe City Code on June 17. 1986 and <br />aaid public bearing was properly advertised and minutes of tbat public bearing <br />are bereby incorporated by reference. <br /> <br />3. That tbe property wbicb is tbe aubject of tbe application is located in <br />Section 6. Townsbip 32. Range 24. ADoka County. Minnesota. <br /> <br />4. That the subject property is located in tbe Scenic River Land Use District. <br /> <br />5. That a tube/canoe rental and shuttle service is not a permitted use in tbis <br />district. <br /> <br />6. That tbe adjoining property is eitber residential or park land. <br /> <br />7. That tbere are no other similar uses in tbis district. <br /> <br />8. That tbere would be a seasonal increase in traffic to tbe area. <br /> <br />9. That tbe propoaed use will not be detrimental to tbe public welfare and <br />will not substantially impair tbe use or enjoyment of any property. <br /> <br />10. That tbe Criteria for Approval/Disapproval are as follows: <br /> <br />a. That tbe Applicant's request to operate a tube/canoe rental and sbutt1e <br />service in tbe Scenic River Land Use District will not be detrimental <br />to tbe bea1tb. safety or general welfare of tbe public; <br /> <br />b. That tbe proposed use will not be unsigbt1y or obnoxious in appearance; <br /> <br />c. That tbe proposed use will not hinder tbe intent or use of tbe Scenic <br />River Land Use District; <br /> <br />d. That tbe proposed use will not restrict the enjoyment of otber property <br />in tbe vicinity; and <br /> <br />e. That tbe proposed use will conform to all otber applicable regulations <br />of tbe Scenic River Land Use District. <br /> <br />11. That tbe Performance Standards are as follows: <br /> <br />a. That fire protection is provided by tbe cities of Anoka and Elk River <br />and tbe proposed use will not create a fire bazard; <br /> <br />b. That tbe proposed use shall not create any electrical disturbance; <br /> <br />II <br /> <br />
