<br />FIIDIIGS OF FACT 101___ <br />JUJl.GD ZUIll'IIBDZI <br /> <br />1. That Mr. Jurgen Zurnieden, hereinafter referred to as "Applicant," has <br />properly applied for a conditional use permit to operate a lawn maintenance and <br />landscaping business from his home at 7721 171st Avenue I.W. <br /> <br />2. That the Applicant appeared before the Planning and Zoning Commission for a <br />public hearing pursuant to Section 170.016 of the City Code on June 3, 1986 and <br />said public hearing vas properly advertised and minutes of that public hearing <br />are hereby incorporated by reference. <br /> <br />3. That the property which is the subject of the application is located at <br />7721 171st Avenue I.W. and is legally described as follows: <br /> <br />Lot 3, Block 2 Golden Eagle Estates, ADoka County, Minnesota. <br /> <br />4. That the subject parcel is approximately 1.6 acres in size and is located <br />in the R-1 residential district. <br /> <br />5. That the property is zoned R-1 residnetial and a lawn maintenance and <br />landscaping business is not a permitted use in this district. <br /> <br />6. That the adjoining properties are zoned R-1 residential. <br /> <br />7. That there are no other similar permitted uses in the R-l residential <br />district. <br /> <br />8. That there would not be a significant increase in traffic flow to the area. <br /> <br />9. That the proposed use will not be detrimental to persons living in that <br />area or to the general public and it will not impair the enjoyment of other <br />properties in the area. <br /> <br />10. That the Criteria for Approval/Disapproval are as follows: <br /> <br />a. That the Applicant's request to operate a lawn maintenance and <br />landscaping business from his home will not be detrimental to the <br />health, safety or general welfare of the public; <br /> <br />b. That the proposed use will not be unsightly or obnoxious "in appearance; <br /> <br />c. That the proposed use will not hinder the orderly development of the R- <br />1 residential district; <br /> <br />d. That the proposed use will not restrict the enjoyment of other property <br />in the vicinity; and <br /> <br />e. That the proposed use will conform to all other applicable regulations <br />of the R-l residential district. <br /> <br />s- <br />...........- <br />
