3. That the motor vehicle repair use will not negatively impact essential public facilities and services, such <br />as highways, streets, police and fire protection. <br />4. That the motor vehicle repair use will not create excessive additional requirements at public cost for public <br />facilities and services and will not be detrimental to the economic welfare of the community. <br />5. That the motor vehicle repair use will not involve uses, activities and equipment that will be detrimental <br />to any persons, property, or the general welfare by reason of excessive production of traffic, noise, smoke, <br />fumes, glare, or odors. <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br />That the Ramsey City Council hereby grants approval of both the Site Plan and a Conditional Use Permit (the <br />"Permit") for the construction and operation of an auto repair business classified as motor vehicle repair on the <br />Subject Property contingent upon the following conditions: <br />CONDITIONS <br />1. That this Conditional Use Permit is valid only for motor vehicle repair and similar vehicle maintenance <br />operations within the definition of "motor vehicle repair." It does not permit the sale of gasoline and other <br />fuels, nor does it permit the sale of vehicles. <br />2. That the site improvements be constructed in accordance with the approved plans. <br />3. That the Permittee shall enter into a Development Agreement with the City of Ramsey. <br />4. That the Permittee agrees to conduct all repair operations inside the building on the Subject Property. <br />5. That the Permittee agrees that there shall not be any automotive parts, oil, or lubricants stored outside on <br />the Subject Property. <br />6. That all visibly damaged vehicles parked outdoors must be located within a screened fenced area along <br />the north side of the building. <br />7. That parking of any vehicle is prohibited on adjacent public roadways. <br />8. That no customer vehicles may remain outside of the fenced area on site after normal business hours. <br />9. That the Permittee shall be responsible for all City costs incurred in administering and enforcing this <br />Permit. <br />10. That the Permittee shall apply for and obtain a building permit and all other necessary permits in <br />accordance with City Staff's review comments, from the City of Ramsey and any other applicable <br />agencies, for the site improvements. <br />11. That the Permittee shall be responsible for operating in full compliance with all applicable local, county, <br />state and federal regulations and agrees to provide a copy of any other required permits. <br />RESOLUTION #24-303 <br />Page 2 of 3 <br />
