with respect to Election Equipment with defects attributable to County's vender or <br />supplier. <br />6. HANDLING OF EQUIPMENT AND INSURANCE <br />Jurisdiction acknowledges that it shall be responsible for the Elections Equipment while <br />it is in the Jurisdictions' custody. Each Jurisdiction, either through insurance or a self- <br />lnsurance prograni, shall be responsible for all costs, fees, damages and expenses <br />including but not limited to personal Injury, storage, damage, repair and/or replacement <br />of the Election Equipment while it's in the Jurisdiction's custody and this contract is in <br />effect. The Jurisdiction shall be responsible for, provide coverage for and shall provide <br />proof of general liability and worker's compensating insurance (Mold Harmless <br />Agreement) for all individuals providing services required by this contract. In addition to <br />the foregoing, the Jurisdiction shall, during the term of this contract, maintain, through <br />commercially available insurance or on a self -insured basis, property insurance coverage <br />on all of the Election Equipment used or Intended for use in this agreement to cover all <br />repairs or replacement of the Election Equipment if damaged or stolen. The Jurisdiction <br />is responsible for any deductible under their policy. <br />7. TERMINATION <br />This Agreement may be terminated by either party upon seven (7) day written notice to <br />the other. Termination of this Agreement by either party and for any reason shall not <br />relieve Jurisdiction of any duties or obligations hereunder including but not limited to <br />the obligation to safely and securely return and deliver the Election Equipment asset <br />forth above. <br />8. DATA PRACTICES <br />The parties, their officers, agents, owners, partners, employees, volunteers and <br />subcontractors shall abide by the provisions of the Minnesota Government Data <br />Practices Act, Minnesota Statutes, chapter 13 (MGDPA) and all other applicable state <br />and federal laws, rules, regulations and orders relating to data privacy or confidentiality, <br />which may include the Health Insurance Portability and Accountability Act of 1996 <br />(HIPAA). <br />9. ADDITIONAL PROVISIONS <br />The parties shall comply with all applicable federal, state and local statutes, regulations, <br />rules and ordinances currently in force or later enacted including but not IIm1ted to the <br />MGDPA, Minnesota Statutes section 16C.05, subd 5 and Minnesota Statutes section <br />471.425, subd, 4a and, as applicable, COUNTY's Affirmative Action Policy. <br />4 <br />
