<br />~ <br /> <br />REB!9 JUN 19 2006 <br /> <br />1111111 IIIII IIIII IIIII 111111111111111 IIII 1111 <br />Record 10 1691245 <br /> <br />~-- <br /> <br />1984829.005 <br /> <br />Chairperson Nixt introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #06-04-114 <br /> <br />A RESOLUTION DECLARING TERMS OF A VARIANCE TO MINIMUM LOT SIZE <br />REQUIREMENTS FOR A COMMUNICATIONS TOWER IN THE TOWER OVERLAY <br />DISTRICT. <br /> <br />WHEREAS, on April 6, 2006, the Ramsey Board of Adjustment issued a variance from <br />Section 9.15.03 of the Ramsey City Code permitting the construction of a wireless <br />communications tower on substandard size lot on the property generally known as 6405 Green <br />Valley Road legally described as follows: <br /> <br />Lot 4 Block I, Valley View Estates, Anoka County, Minnesota <br /> <br />(the "Subject Property") <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF ADJUSTMENT <br />OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />1. Based on Findings of Fact #0758, a variance to minimum lot size for a wireless <br />communications tower in the Tower Overlay District is hereby granted. <br /> <br />2. That the Applicant is required to obtain a Conditional Use Permit for the construction of the <br />communications tower prior to the commencement of any such work. <br /> <br />3. That the Applicant is required to obtain all other necessary permits for the construction of the <br />wireless communications tower. <br /> <br />4. That the construction and installation of the wireless communications tower shall adhere to <br />the approved site plan dated March 17, 2006. <br /> <br />5. That the Applicant shall be responsible for all City costs incurred in administering and <br />enforcing this variance. <br />
