<br />Board Member Levine introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #06-05-143 <br /> <br />A RESOLUTION ADOPTING FINDINGS OF FACT #0761 RELATING TO A <br />REQUEST FOR A VARIANCE FROM MAXIMUM CUL-DE-SAC LENGTH <br />RESTRICTION FOR NUTRIA STREET WITHIN WILD OAKS OF RAMSEY <br /> <br />WHEREAS, Ron Tallman, hereinafter referred to as "Applicant", has properly applied <br />for a Board of Adjustment variance to the cul-de-sac length of 600 feet established in Section <br />9.50.30, Subd. 3 (g) of the Ramsey City Code on the property generally located on County Road <br />63 and Nutria Street and legally described as <br /> <br />The west half of the northwest quarter of the northeast quarter of Section 8, Township 32, <br />Range 25, According to the U.S. Government Survey, ANOKA COUNTY, MINNESOTA <br /> <br />AND <br /> <br />The north 447.60 feet of the east 526.00 feet, as measured along the east and north lines, <br />respectively, of the northeast quarter of the northwest quarter of Section 8, Township 32, Range <br />25, According to the U.S. Government Survey, ANOKA COUNTY, MINNESOTA <br /> <br />AND <br /> <br />That part of the east 542.00 feet, as measured parallel with the north line of said northeast <br />quarter of the northwest quarter, lying south of the north 447,60 feet, as measured along the east <br />line of said northeast quarter of the northwest quarter, Section 8, Township 32, Range 25, <br />According to the U.S. Government Survey, ANOKA COUNTY, MINNESOTA. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF ADJUSTMENT <br />OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />1. That the Applicant appeared before the Board of Adjustment for a public hearing pursuant to <br />Section 9.03.05 of the Ramsey City Code on May 4th, 2006, and that said public hearing was <br />properly advertised and that the minutes of said public hearing are hereby incorporated as a <br />part of these findings by reference. <br /> <br />2. That Section 9.50.30, Subd. 3(g) of City Code limits the length ofa cul-de-sac to 600 feet. <br /> <br />3. That the applicant is requesting a variance of 500 feet, for a total cul-de-sac length of 1,100 <br />feet to extend the proposed Nutria Street N.W. to the boundary of the plat and to access <br />proposed lots. <br /> <br />4. That the plat is proposed in an area of the city that lacks fire hydrants. <br /> <br />5. That undue hardship or practical difficulty will result if the variance is denied due to the <br />existence of special conditions and circumstances which are peculiar to the land, such as <br />exceptional topographic conditions. <br />
