<br />Councilmember Olson introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #06-05-147 <br /> <br />RESOLUTION ADOPTING FINDINGS OF FACT #0762 RELATING TO A REQUEST <br />FOR PRELIMINARY PLAT APPROVAL OF SHADE TREE CREEK <br /> <br />WHEREAS, Shade Tree Communities, (the "Developer") has properly applied for <br />preliminary plat approval of Shade Tree Creek addition (the "Plat') on the following described <br />property located in the City, to-wit: <br /> <br />The Northwest Quarter of the Southwest Quarter of Section 1, Township 32, <br />Range 25, Anoka County, Minnesota. <br /> <br />Subject to an easement for road purposes over the west 66.00 feet of the east <br />250.81 feet thereof. <br /> <br />(the "Subject Property") <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA that the findings of fact relating <br />to the request are determined to be as follows: <br /> <br />1. That Section 9.20.11 (R-1 Residential District) of the City Code requires all subdivisions <br />(plats) in the City's Rural Developing Zoning District Area to be developed as a cluster <br />subdivision. <br /> <br />2. That on May 5, 2005 the Planning Commission at a regularly scheduled meeting met and <br />reviewed the sketch plan for the Subject Property. At the May 5, 2005 meeting members <br />of the Planning Commission expressed concern with the lack of density transitioning and <br />the location of the lots in the Plat. At said May 5th meeting members of the Planning <br />Commission provided comments and feedback to the Developer. A copy of the Planning <br />Commission's May 5, 2005 minutes are incorporated herein by reference. <br /> <br />3. That on April 4, 2006, the City received the Developer's application for the preliminary <br />plat of the Plat. The Subject Property consists of approximately 40 acres and the <br />proposed Plat provides for 16 residential lots. <br /> <br />4. That the Planning Commission conducted a public hearing pursuant to Section 9.03.03 of <br />the City Code on April 24, 2006 and said public hearing was properly advertised (the <br />"Public Hearing"). The minutes of the Public Hearing are hereby incorporated by <br />reference. <br /> <br />5. That at the Public Hearing, the Planning Commission reviewed the application for <br />preliminary plat, and recommended denial of the Preliminary Plat based on the following <br />reasons: 1) the Plat's lack of sufficient landscaping to address density transitioning <br />concerns; 2) the location of the proposed lots in the Plat are incompatible with the <br />existing residential lots adjacent to the Plat; and 3) the public safety concerns related to <br />single-access neighborhoods. <br />
