<br />10 Minutes CASE #2: <br /> <br />REQUEST FOR METES AND BOUNDS SUBDIVISION OF <br />LOT 4, BLOCK 1, VOLTIN'S OAK HILL ESTATES; <br />CASE OF MR. DAVID SCHULTE <br />By: Anne Norris, Community Development Director <br />Bill Goodrich, City Attorney <br /> <br />Background: <br /> <br />Mr. David Schulte is requesting a metes and bounds subdivision of Lot 4, Block <br />1, Voltin's Oak Hill Estates in order to split that part of the lot north of <br />the drainage ditch from that property south of the ditch. The proposed <br />subdivision will create a landlocked parcel south of the drainage ditch. <br /> <br />At the time Mr. Schulte platted Voltin' s Oak Hill Es ta tes, the City Council <br />stipulated that Lot 4, Block 1 would not be developed until southerly access to <br />that lot was provided by the developer. In November 1987, the City Attorney <br />interpreted this condition to mean that one building permit could be issued for <br />Lot 4, Block 1 but that Lot 4 could not be subdivided until access is provided <br />for the southern portion of the lot. <br /> <br />Enclosed are the following items for your information: <br /> <br />a) Site location map <br />b) Proposed metes and bounds subdivision <br />c) City Council meeting minutes dated February 25, 1986 <br />d) Development agreement for Voltin's Oak Hill Estates - see Condition #9 <br /> <br />Recommendation: <br /> <br />As Mr. Schulte's request would create a landlocked parcel and contradicts one <br />of the terms of the development agreement for Voltin's Oak Hill Estates, Staff <br />recommends denial of this request. <br /> <br />Council Action: <br /> <br />Motion to: <br />Deny Mr. David Schulte's request for a metes and bounds subdivision. <br /> <br />Review Checklist: <br /> <br />Administrator <br />Attorney <br />Engineer <br />Community Development Director <br /> <br />Chief of Police <br />Finance Officer <br />Public Works Superintendent <br />Other <br /> <br />.x.. <br />...L. <br />...L <br />...L <br /> <br /> <br />23 <br />
