<br />ARTICLE II. CITY TO PREPARE PLANS AND EVALUATE FINANCIAL. <br />FEASIBILITY. The City shall study the feasibility of <br />constructing site improvements to allow development of the <br />Property. In conducting the study, the City may use the services <br />of its consul t ing eng ineer and such other persons as may be <br />reasonably necessary. A report regarding the feasibility of the <br />site improvements shall be prepared within a reasonable period of <br />time,. not to exceed two months from the date of th is Agreement. <br />The Developer agrees to cooperate with the City in the <br />preparation of the feasibility report. If the construction of <br />the site improvements is determined to be feasible, the City <br />shall prepare plans and specification for that purpose. In <br />addition, the City shall evaluate the financial feasibility of <br />the Project wi thout publ ic assistance and, if the Project is <br />found to be financially infeasible, shall examine the use of TIF <br />to offset all or a portion of the cost of the site improvements. <br /> <br />ARTICLE III. EASEMENT. The Developer hereby grants and conveys <br />to the City and its agents, its and their successors and assigns, <br />an easement over and upon the Property for the purpose of ingress <br />and egress and for conducting such tests or collecting such data <br />as may be reasonably necessary to determine the feasibility of <br />the Project. The easement shall terminate upon completion of the <br />feasibility study, or two months from the date of this Agreement, <br />whichever occurs first. <br /> <br />2 <br />
