The state is currently considering a rule change covering this item. The rule will have an effectivity date of 1990. We do not bel ieve these seminars are being clffered yet. 130 . 1 27. Lawful gambl ing at on-sale establ ishments. (a) Only class B and class D gambl ing 1 icenses may be issued, except where the 1 icensed gambl ing organization also holds the on-sale 1 iquor, wine, or 3.2 beer 1 icenses for the premises, in which case any class of gambl ing 1 icense may be issued. This ordinance clause appears to have meaning only for private clubs such as VFW, American Legion, etc. The Class A 1 icense is for all forms of lawful gambl ing, Class B 1 icense is for all forms of lawful gamb1 ing except bingo, Class C 1 icense is for bingo only, and Class D 1 icense is for raffle only. (c) Every agreement between a non-profit organization and an on-sale premise for gambl ing shall be in the form of a written lease. The written lease shall be the complete agreement between the parties, and there shall be no unwritten terms or conditions... COMMENT: This item also is much more restrictive than the Minnesota statute. Paragraph 7860.0090 of the state rules cover the leasing agreement in great detail. Is there a need in Ramsey to further r~strict the lawful agreement between lessee and lessor as long as the lease conforms to the -Minnesota Charitable Gambl ing Control 8oardrules?
