Case Of Mr. Jeff Erikson:
Mr. Erikson was present.
Chairman Zimmerman noted that the City Attorney has determined that even
though the property is located in the B -1 Business district, the principal
use of the property is residential; therefore, Mr. Erikson's accessory
structure should be subject to residential standards.
Ms. Norris noted that the 16 foot height limitation for accessory
structures applies to commercial and industrial zones as well as
residential zones. Ms. Norris also noted that the City Attorney has also
stated that if Mr. Erikson desires to use the accessory structure for
commerical purposes, he would have to go through the conditional use
process because his primary use of the property is residential.
The Commission proceeded to review the proposed findings of fact.
Motion by Commissioner Deemer and seconded by Commissioner Peterson to
adopt Findings of Fact 0160 relating to Mr. Erikson's request for a
variance from the maximum height allowance for accessory structures,
amended as follows:
Item #8 — Should read as follows: 'That the Applicant is proposing
to construct an accessory structure approximately 22 feet in height,
which is also higher than the principal structure.'
Motion carried.
