Attorney <br />Subj: Conditional Use Permit Request of Jeff Erickson, <br />15270 St. Francis Blvd. <br />It is my understanding that Jeff Erickson has applied for a <br />conditional use permit to construct and operate an office and <br />warehouse for an electrical contracting business at 15270 St. <br />Francis Blvd. <br />As you know, the subject property is in the City's B -1 zoning <br />district. In addition, a pre- existing residential home is al- <br />ready located on the property, which prior to this time, was <br />the principal use of the property. In addition, in 1987 Mr. <br />Erickson applied for a variance to allow for the construction <br />of an accessory building on his property which would have ex- <br />ceeded the height limitation permitted in a residential zone. <br />It is my understanding that Mr. Erickson wants the parcel to <br />remain B -1 and operate a business from the premises as well <br />as live on the site. In addition, Anne Norris advises me that <br />the City would like to keep the property in its present B -1 <br />zone. <br />It is my opinion that Mr. Erickson's plan is workable. I suggest <br />that because of Mr. Erickson's continued interest in using <br />his property as commercial, and, of course, because it is zoned <br />commercial (B -1), that the residential use be considered noncon- <br />forming, with the goal of some day, consistent with the City's <br />non - conforming use regulation, Section 170.015H, of phasing <br />out the residential use. <br />If the Commissioners and Mr. Erickson accept this reasoning, <br />which I believe to be the best characterization of the subject <br />property under our zoning ordinance, then Mr. Erickson will <br />not be required to obtain a conditional use permit. He will, <br />however, be required to obtain a site plan permit as required <br />by Section 170.017L of the zoning ordinance. <br />
